Clear Solutions LLC, doing business as CS Fitness ("CS Fitness," "we," "us," or "our"), operates the website https://www.csfitnessusa.com and provides EMS training and body composition analysis services at 180 S Stephanie St, Suite 120, Henderson, NV 89012.
By using our website or purchasing our services, you agree to these Terms of Service.
1. Age Requirement
You must be at least 18 years of age to use our website or participate in any CS Fitness service. By submitting information to us or purchasing services, you confirm that you are 18 or older.
2. Services
CS Fitness offers EMS (Electrical Muscle Stimulation) training sessions and body composition analysis. Services are provided in person at our Henderson, Nevada location.
3. Health Eligibility and Waiver
Prior to participating in any CS Fitness session, including the complimentary introductory session, you are required to complete a health screening waiver and release form. Certain medical conditions may disqualify participation in EMS training. If you are unsure whether EMS training is appropriate for you, consult your physician before participating.
CS Fitness reserves the right to refuse service to any individual whose health condition may pose a risk to themselves or others. Any such determination is made solely for safety purposes and is not intended to discriminate against any individual on the basis of disability or any other protected characteristic.
4. Free Intro Session
CS Fitness offers a complimentary introductory EMS session to eligible new prospective clients at its discretion. No credit card is required to book or attend the free intro session. The free intro session is available once per person and is non-transferable.
5. Billing
A valid credit card on file is required for all paid memberships. By providing your credit card, you authorize CS Fitness to charge your membership fee automatically on your billing date.
6. Cancellation Policy
CS Fitness maintains a session cancellation and rescheduling policy. Late cancellations may result in session forfeiture. Specific notice requirements and cancellation terms are detailed in your Membership Agreement. CS Fitness reserves the right to update its cancellation policy at its discretion.
7. Refund Policy
All purchases are non-refundable. Membership terms are governed exclusively by your signed Membership Agreement. This refund policy does not affect any rights you may have under applicable Nevada consumer protection law.
8. Text Message Communications
By providing your phone number to CS Fitness through our website or in person, and by providing your consent where required, you agree to receive text messages from CS Fitness regarding your inquiry, appointments, reminders, and where separately consented to, marketing or promotional messages.
Consent to receive text messages is not required to purchase any goods or services. Message and data rates may apply. Message frequency varies. Reply STOP at any time to unsubscribe from text messages.
9. No Medical Advice
CS Fitness is an EMS fitness studio and is not a medical provider. Nothing communicated by CS Fitness staff, on our website, in our marketing materials, or during sessions constitutes medical advice, diagnosis, or treatment. EMS training is provided solely for fitness and wellness purposes.
You should consult a qualified physician or healthcare provider before beginning any new fitness program, including EMS training, particularly if you have any existing medical condition, injury, or health concern.
CS Fitness does not claim that EMS training treats, cures, or prevents any medical condition or disease. Any results mentioned in our marketing materials or by our staff are individual experiences and are not guaranteed.
10. Intellectual Property
All content on our website including text, images, logos, and graphics is the property of Clear Solutions LLC DBA CS Fitness and may not be reproduced, distributed, or used without our written permission.
11. Limitation of Liability
To the fullest extent permitted by applicable law, CS Fitness shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our website or services. To the fullest extent permitted by applicable law, our total liability to you for any claim arising out of or related to these Terms or our services shall not exceed the total amount you paid to CS Fitness in the 30 days preceding the claim.
12. Indemnification
You agree to indemnify and hold harmless Clear Solutions LLC DBA CS Fitness, its owners, staff, and agents from any claims, damages, or expenses arising from your use of our services, your violation of these Terms, or your violation of any applicable law.
13. Governing Law
These Terms are governed by the laws of the State of Nevada without regard to its conflict of law provisions. Before initiating any legal action, you agree to contact CS Fitness in writing at henderson@csfitnessusa.com and allow 30 days for informal resolution. Any disputes that cannot be resolved informally shall be resolved through binding arbitration in Clark County, Nevada under the rules of the American Arbitration Association, on an individual basis only. You waive any right to participate in a class action lawsuit or class-wide arbitration against CS Fitness. Nothing in this section prevents CS Fitness from seeking injunctive relief in any court of competent jurisdiction.
14. Changes to These Terms
We may update these Terms of Service from time to time. Changes will be posted on this page with a revised date. Your continued use of our website or services after changes are posted constitutes your acceptance of the updated Terms.
